Arches Corporation and its group companies (hereinafter collectively referred to as “the Company”) shall use confidential information of the user based on this policy.

1. Information acquired by the Company

Information acquired by the Company to achieve the specified purposes in 4. Purposes of using the acquired information includes the information below (Section (1) and (2) below, hereinafter collectively referred to as “acquired information”).

(1) Information acquired by the Company from the user

Personal information means information of individuals defined in Article 2 (1) of Act on the Protection of Personal Information of Japan, and especially the information below shall be considered as personal information.

  1. Address, name, date of birth, gender, occupation and other information that can identify specific individuals.
  2. Address, phone number, account information (email address and password, etc.) which are used in connection with specific personal information.
  3. Bank account information and credit card information.
  4. Hobbies, family structure, age, and other attribute information related to individuals, which are associated with personal information.
  5. Information related to user’s self certification.

(2) Information acquired by the Company related to the user’s use of our service

The Company acquires the following information related to the use of the service, regardless of whether or not this information belongs to personal information.

  1. Information related to the content, date, time, and number of the service used by the user, and information related to the use of our service by the user such as the users’ online behavior when using our service (which includes information related to usage such as cookie information and access logs, terminal information, location information, and information related to the user’s communication including IP address, browser information, and browser language).
  2. Information related to the payment through the use of our service by the user.

2. Information collection methodology

The Company acquires the information of the user using our service in the following ways.

  1. Ask the user to fill in information directly on our service.
  2. Ask the user to provide information to the Company via email, mail, document, phone, etc. (When communicating by phone with the user, the Company records the conversation to improve the response quality).
  3. Obtain information when the user uses and browses our service.
  4. Obtain information that is made available by the person and receive personal information lawfully obtained from a third party.

3. Management of acquired information

At the Company, the person in charge of managing and using the acquired information shall strictly manage the information, paying close attention to the handling of the acquired information to prevent unauthorised access to, and loss, leak or tampering of personal information.

4. Purposes of use of acquired information

The Company uses the acquired information for the purpose of use that was notified to the user when obtaining and collecting such information, the purpose set forth in the Terms of Use, and the following purposes.

  1. To provide services of the Company. This purpose also includes providing corporate information (without names and contact information) for matching with the user who wants to use our services.
  2. To promote and provide various types of products and services, including products and services of the Company and partner companies, and manage the contracts.
  3. To provide information, manage operation for the Company’s businesses, and improve products and services.
  4. To notify and provide information about items related to our service.
  5. To simplify the entry of necessary information when registering users for our service.
  6. To send confirmation of registration and send email in relation to the e-mail delivery service. 
  7. To survey and analyze the usage of our service.
  8. To innovate and improve user satisfaction with the content of our service or develop new services.
  9. To customize our service content for the user.
  10. To investigate the level of satisfaction with our service.
  11. To collect information after statistically processing the acquired information and publicize that information as a survey result.
  12. To send instructions or announcements about our service, new services and other types of services.
  13. To request participation to research or event and announce the result.
  14. To distribute or display the Company’s or third party’s ads.
  15. To solve problems regarding the operation of our service.

5. Provision of acquired information to group companies

The Company may provide acquired information to the following group companies abroad for the purposes specified in 4. Purposes of using the acquired information.

6. Delegation to a third party for processing received information

The Company provides the acquired information to a third party in the following cases. In addition, in the event that the Company determines that it is necessary to provide the acquired information, it may provide such information after obtaining the consent of the user. 

  1. Where information is provided on our service when the Company considers it necessary to provide such service. 
  2. Where the Company considers it necessary to operate and provide services.
  3. Where providing to a contractor or other third party to resolve users’ inquiries, the Company’s inquiries to the user, related after-sales service, etc.
  4. Where required by the court, administrative agency, supervisory agency and other public agencies to provide the acquired information in accordance with the law.  
  5. Where the Company considers it necessary to provide information to resolve a dispute with a third party, or to ensure the rights and interests of the user or the third party.
  6. Where providing to a third party that the Company entrusts the survey and analysis to conduct surveys and analyze the usage of our service.
  7. Where providing to affiliated companies for the promotion and provision of products and services of such companies
  8. Where providing to a third party to distribute or display the Company’s or third party’s ads.

7. Delegation to a third party for processing acquired information

The Company may delegate all or part of the processing of acquired information to a contractor within the scope necessary to implement 4. Purposes of using acquired information. In this case, the Company thoroughly verifies whether the transferee of such work satisfies the criteria for selecting the delegated party as provided by the Company and ensures the acquired information is managed appropriately during the contract.

8. Use of Cookie

The user may decide whether to allow the use of Cookie or not. In many web browsers, the use of Cookie is automatically allowed, but browser settings can also be changed to block the use of Cookie.

  1. When blocking Cookie, it may not be possible to use our service normally, and advertising settings that need to use Cookie may not be displayed.
  2. The Company acquires the user’s Cookie information and information on advertising and websites that the users have viewed, or the environment used by the user from the browser automatically. The information is then recorded on the server and used in order to enhance the convenience such as automatically entering the email address when logging in to our service, ensure security such as maintaining and protecting sessions, as well as consider new services and improve content of advertising and services more relevant to the user.

9.  Use of Log and Device Information

  1. Log

The Company acquires information such as IP addresses, browser types, and browser languages, which are automatically generated when users visit our service.

Later, this information will be used to analyze the user environment in order to provide better service and prevent unauthorized behavior that prevents the provision of normal services. Furthermore, search records will be stored and preserved in a state that cannot be identified individually and used for the purposes including making statistical data.

  1. Device information

The Company may acquire device information such as individual identification information of the terminal. 
This information is used to provide better services and to prevent unauthorized acts from obstructing the provision of normal services.

10. Behavior Targeted Advertisement

  1. When providing our service or affiliate service, the Company collects, stores, and uses the following information using information collection module in order to implement targeted advertising (an advertising method that delivers advertisements customized to the user’s needs, interests, or concerns) by us or third parties such as ad-serving businesses.
    1. Behavioral history information (information that can be used to analyze user needs, interests, and concerns through the accumulation of such information, such as usage history of our service, but cannot be used to identify specific individuals.)

The Company will provide the information collected in accordance with the preceding section to businesses that provide behavioral targeting advertisement services (hereinafter referred to as “Ad-serving Providers”) for the purpose of delivering useful information to users by sending optimal advertisements customized to their needs, interests, or concerns.
  3. The Company will retain the information collected from the user such as behavioral history information only for as long as is legally  and legitimately necessary for business purposes.
  4. When providing information such as behavioral history information to Ad-serving Providers, the Company strives to establish the following measures to prevent leakage, loss or damage to such information and to manage information security.
    1. Not publicize mechanisms for encryption of behavioral history information, etc., such as algorithms.
    2. Provide behavioral history information to Ad-serving Providers, provided that such information is used only within the scope of the purpose of use specified in Clause 2.
    3. Where the Ad-serving Provider provides behavioral history information to another third party, the Ad-serving Provider is obliged to provide such information to such third parties under the same conditions as those described in the preceding item.

11. Correction of personal information by the Company

In the event of a change in personal information that interferes with the provision of our service or payment request such as postal code, financial institution name, or credit card validity period, the Company may change the registered personal information.

12. Management and security of personal information

The Company securely stores all the collected information on servers that are inaccessible to the general public and strives to prevent unauthorized access to or loss, destruction, tampering or leaking of information.

13. Improvement and update of the Privacy Policy

The Company strives to improve this Privacy Policy appropriately.

  1. The Privacy Policy may be changed to be compatible with changes in legislation, requirements of the business operation, etc. The Company will notify the user in case of changes in the Privacy Policy by displaying the revised policy on the website.
  2. Before accessing our service or using the Company’s services, users are encouraged to read the latest Privacy Policy.

14. Procedures for disclosing, modifying and terminating personal information use

The user may check and edit registered information at any time on our service.

Users may request the Company to disclose the personal information that cannot be checked on our service, the user may request to disclose such information according to the procedures specified by the Company, except in the following cases:

  1. If the disclosure is likely to harm the life, body, property, or other rights or interests of the person or a third party.
  2. If the disclosure is likely to seriously impede the proper execution of the business of the CompanyCompany.
  3. If the disclosure violates other laws and regulations.
  4. If it is impossible to verify that the request is made by the person themselves.

    If the user, after the disclosure, finds that the content of personal information held by the Company is not true, the user may request to modify, add, or delete such information in accordance with procedures specified by the Company. In this case, the Company will immediately conduct a review to the extent necessary to achieve the purposes of use and rely on that result to make corrections, additions or deletions of personal information.

    If the user requests the disclosure of personal information that cannot be checked on our service, the user may be required to pay a disclosure fee according to the procedures specified by the Company.

15. Severability

In the event any provision of this Privacy Policy is held to be unenforceable, the remaining provisions of this Privacy Policy will remain in full force and effect. The unenforceable provisions shall be automatically amended to the extent necessary to make them valid and enforceable, provided that any such amendments shall most closely reflect the intent and purpose of the original provisions.
